HMB Crestmonte Holdings, LLC (“Givo,” “we,” “us,” or “our”) operates the Givo mobile application, website at givogolf.com, and related services (collectively, the “Services”).

This Privacy Policy explains what information we collect, how we use it, when we share it, and the choices available to you. By using the Services, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect

Information You Provide

Depending on how you use Givo, we collect:

  • Waitlist information: Your email address when you join our early-access or waitlist program.
  • Account information: Your name, email address, login credentials, and other information needed to create and manage your account.
  • Golf profile information: Your handicap, home course, club information, estimated carry distances, and other golf-related information you choose to provide.
  • Round and performance data: Scores, putts, fairways hit, greens in regulation, penalties, hole-by-hole information, shot information, and other performance data.
  • Practice information: Practice plans, drills, drill results, completion history, feedback, and other information you provide about your practice.
  • AI caddie conversations: Messages, questions, instructions, and other information you provide through Givo's AI features, including information submitted through voice-input functionality where available.
  • Social information: Your display name, group memberships, scores, achievements, and other information you choose to make available through Givo's social features.
  • Support communications: Information you provide when contacting us for support or other assistance.

Information Collected Automatically

Depending on the features you use and your device settings, we may automatically collect:

  • Location information: Precise location information when you use features that require GPS or location services, such as on-course tracking. Givo does not require continuous background location access for these features.
  • Voice-input information: When you use voice-input functionality, your speech may be processed to convert it into text. We do not intend to retain audio recordings after processing unless we specifically disclose otherwise.
  • Device and usage information: Information such as device type, operating system, app version, diagnostic information, and information about how the Services function.
  • Local storage information: Certain information may be stored locally on your device to provide functionality.
  • Cookies and similar technologies: Our website may use cookies or similar technologies that are necessary to operate the website and understand technical usage. We will disclose additional analytics or advertising technologies if and when we implement them.

Guest Use

Certain Givo features, including course-related features accessed through a QR code or similar guest experience, may be available without creating an account.

If you use Givo as a guest, we collect only the information needed to provide the feature, such as location and course-related information. Guest information is not linked to your identity unless you choose to create or sign in to a Givo account.

Information From Third-Party Services

If you connect Givo to another service or device, we may receive information that you authorize that service to provide. Any such integrations will be described within the Services.

We may also receive information necessary to process subscriptions or payments from app stores, payment processors, or other transaction providers. We do not receive or store your full payment card number.

2. How We Use Information

We use information we collect to:

  • Provide and operate Givo's core features, including GPS functionality, scoring, statistics, strokes-gained analysis, and other golf tools.
  • Provide AI caddie conversations, round debriefs, personalized recommendations, and practice plans.
  • Personalize your experience based on information such as your golf profile, performance, practice history, and preferences.
  • Provide social features such as groups, leaderboards, and achievements.
  • Create, maintain, and manage your account and subscription.
  • Communicate with you about your account, Services, early access, product updates, and promotional offers where permitted.
  • Respond to support requests and provide customer service.
  • Maintain the security, reliability, and functionality of the Services.
  • Detect, prevent, and address fraud, abuse, and unauthorized access.
  • Troubleshoot technical problems and improve the Services.
  • Create aggregated or de-identified information that does not reasonably identify you, which we may use for legitimate business purposes.
  • Comply with applicable laws, legal obligations, and lawful requests.

We do not sell your personal information. We do not share your personal information for targeted advertising. We do not use your precise location for targeted advertising.

3. How We Share Information

We may share information with the following categories of recipients:

Service Providers

We use third-party companies and service providers to help us operate Givo, including providers for:

  • Hosting and infrastructure
  • Account authentication and database services
  • AI functionality
  • Voice or speech processing
  • Email and communications
  • Course, mapping, and golf-related data
  • Payment and subscription processing
  • Security, diagnostics, and technical services

These providers may access information as reasonably necessary to perform services for us or as otherwise permitted by applicable law and their agreements with us.

Other Givo Users

If you use social features, certain information you choose to share may be visible to other users. This may include your display name, scores, achievements, group membership, or other information associated with those features.

Your email address, precise location information, and other private account information are not publicly displayed through Givo's social features.

Courses and Golf Businesses

If you use a Givo-powered digital yardage book, scorecard, or other course-related feature, we may provide participating golf businesses with aggregated or de-identified usage information.

We will not share your name or contact information with a golf business without your permission.

Legal and Safety Reasons

We may disclose information when reasonably necessary to:

  • Comply with applicable law, regulation, legal process, or governmental request.
  • Protect the rights, property, or safety of Givo, our users, or others.
  • Detect, investigate, or prevent fraud, security issues, or unlawful activity.
  • Enforce our Terms of Service or other agreements.

Business Transfers

If Givo or substantially all of its assets are involved in a merger, acquisition, financing, reorganization, sale, bankruptcy, or similar transaction, information may be transferred as part of that transaction, subject to applicable law.

4. AI Features

Givo uses artificial intelligence to provide features such as golf recommendations, round analysis, practice plans, and conversational assistance.

Depending on the feature you use, AI systems may process information such as:

  • Your golf profile
  • Club information and estimated distances
  • Round and performance data
  • Practice history and results
  • Questions and messages you submit
  • Information from other Givo features that is relevant to your request

AI-generated information may be incomplete, inaccurate, or inappropriate for a particular situation. You are responsible for using your own judgment when acting on AI-generated recommendations.

Your information may be processed by third-party AI service providers that help us operate these features.

5. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, maintain your account, fulfill the purposes described in this Privacy Policy, resolve disputes, enforce agreements, and comply with legal obligations.

Generally:

  • Waitlist information may be retained while you remain subscribed to launch or product communications or until you unsubscribe or request deletion.
  • Account, golf profile, round, and practice information may be retained while your account is active.
  • AI conversations may be retained while reasonably necessary to provide relevant features and maintain your account.
  • Support communications may be retained as reasonably necessary to provide support and maintain appropriate business records.
  • Certain information may remain temporarily in backups or security systems after deletion.
  • Aggregated or de-identified information that cannot reasonably be used to identify you may be retained for legitimate business purposes.

When you request account deletion, we will delete or de-identify your personal information within 30 days, subject to legal requirements and information that must temporarily remain in backups or security systems.

6. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information from unauthorized access, use, alteration, or disclosure.

These measures may include encrypted connections, secure credential handling, access controls, authentication protections, and other security measures appropriate to the nature of the information.

No method of transmitting or storing information is completely secure, and we cannot guarantee absolute security.

If we become aware of a security incident involving your information, we will provide notices required by applicable law.

7. Your Choices and Rights

Depending on where you live and applicable law, you may have rights concerning your personal information, including the ability to:

  • Access information we maintain about you.
  • Correct inaccurate information.
  • Request deletion of your information.

You can manage certain information directly through your Givo account.

You may also request account deletion through the account-management functionality provided within the Services or by contacting us at support@givogolf.com.

You can control location permissions through your device settings. You may also disconnect third-party services or integrations through the options made available within Givo.

You can unsubscribe from promotional emails using the unsubscribe option included in those communications. We may continue to send service-related communications that are necessary to operate your account or provide the Services.

We may need to verify your identity before completing certain privacy requests. We will respond to valid requests within the time required by applicable law.

We provide rights required by applicable law and may extend certain rights to users who are not otherwise legally entitled to them.

8. Children's Privacy

Givo is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

If we learn that we have collected personal information from a child under 13, we will delete it.

Users aged 13 to 17 may use Givo only with the consent of a parent or legal guardian.

A parent or legal guardian who has questions about a minor's information may contact us at support@givogolf.com.

9. Where Information Is Processed

Givo and our service providers may process and store information in the United States and other countries where our service providers operate.

If you use Givo from outside the United States, your information may be transferred to and processed in the United States or another country that may have different data-protection laws than your country of residence.

10. Third-Party Services and Links

Givo may contain links to or integrations with third-party websites, services, or applications.

We are not responsible for the privacy practices of third parties. We encourage you to review the privacy policies of any third-party service you choose to use.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time.

If we make material changes, we may provide notice through the Services, by email, or through another appropriate method before the changes become effective when required by applicable law.

The “Last Updated” date at the top of this Privacy Policy indicates when it was most recently revised.
